Information for potential clients under the State Program of Affordable Mortgage Lending "YeOselya"

The State Program of Affordable Mortgage Lending of Citizens "YeOselya" (hereinafter - the "YeOselya" Program) has been developed in accordance with:
  1. Resolution of the Cabinet of Ministers of Ukraine dated 02.08.2022 No. 856 (as amended) (hereinafter referred to as the Resolution) "Certain issues of providing affordable mortgage lending to citizens of Ukraine by the Private Joint-Stock Company "Ukrainian Financial Housing Company" (hereinafter - PJSC "UFZHK");
  2. Resolution of the Cabinet of Ministers of Ukraine dated December 16, 2022, No. 1397 "On amendments to certain resolutions of the Cabinet of Ministers of Ukraine regarding the provision of affordable mortgage lending to citizens of Ukraine" (hereinafter - Resolution No. 1397);
  3. Resolution of the Cabinet of Ministers of Ukraine dated July 04, 2023, No. 710 "On amendments to the Conditions for providing affordable mortgage lending to citizens of Ukraine by the Private Joint-Stock Company "Ukrainian Financial Housing Company"" (hereinafter - Resolution No. 710);
  4. Resolution of the Cabinet of Ministers of Ukraine dated December 22, 2023, No. 1357 "On amendments to the resolutions of the Cabinet of Ministers of Ukraine dated August 2, 2022, No. 856 and May 30, 2023, No. 600" (hereinafter - Resolution No. 1357);
  5. Resolution of the Cabinet of Ministers of Ukraine dated August 16, 2024, No. 939 "On amendments to the Conditions for providing affordable mortgage lending to citizens of Ukraine by the Private Joint-Stock Company "Ukrainian Financial Housing Company"" (hereinafter - Resolution No. 939).


Criteria for potential Borrowers eligible for a loan under the "YeOselya" Program:


1. Individuals - citizens of Ukraine,
 

who have full legal capacity in accordance with the legislation of Ukraine (hereinafter - the Borrower) and do not own residential real estate or have less than 52.5 square meters in ownership for a single-person family, and an additional 21 square meters for each subsequent family member.

Borrower's Age: from 18 years to 70 years (at the date of full compliance with the obligations under the loan agreement).

The Borrower and his family members do not own residential real estate (as well as future residential real estate objects, special property rights to which are registered in the State Register of Property Rights to Real Estate) with a total area equal to or exceeding 52.5 square meters - for a single-person family and an additional 21 square meters per each subsequent family member (residential real estate objects located in active conflict zones, territories with active military operations, on which state electronic information resources operate, or temporarily occupied by the Russian Federation territories of Ukraine included in the list of territories with ongoing (past) military operations or temporarily occupied by the Russian Federation, approved by the Ministry of Reintegration, for which the end date of hostilities or temporary occupation is not determined (hereinafter - territories)), as well as destroyed or damaged real estate objects, the owner (co-owner) of which is the candidate and/or his family members);

The Borrower and his family members within 12 months prior to the date of submitting the application for a loan have not disposed of residential real estate, the total area of which together with the area of the living space owned by the family at the date of submitting the application exceeds 52.5 square meters - for a single-person family and an additional 21 square meters per each subsequent family member (objects of residential real estate located on active conflict zones, or objects of real estate destroyed or damaged, the owner (co-owner) of which is the candidate and/or his family members, are not taken into account).

2. Categories of citizens who are eligible for a loan with an interest rate subsidy (3% per annum for 10 years from the date of conclusion of the loan agreement, 6% per annum starting from the first day of the 11th year of the loan agreement): 

1) Armed Forces servicemen under contract, Security Service of Ukraine, Foreign Intelligence Service, Main Intelligence Directorate of the Ministry of Defense, National Guard, State Border Guard Service, State Protection Department, State Special Communications Service, State Special Transport Service, prosecutors of specialized prosecutor's offices in defense sphere of the Office of the Prosecutor General, personnel of the State Emergency Service, employees of the Court Security Service, detectives, senior detectives, and personnel of the National Anti-Corruption Bureau, personnel of the State Investigation Bureau, detectives and personnel of the Bureau of Economic Security, police officers, as well as family members of the mentioned individuals.
With the purpose of determining the eligibility for compensation of part of the interest rate for loans provided in accordance with the Resolution, the categories of persons specified in this subparagraph also include persons who have been dismissed from the positions specified in the first paragraph of this subparagraph or have lost the corresponding status or rank as a result of obtaining the status of a disabled person of groups I or II as a result of war after obtaining the loan according to the Conditions of the Resolution, for the period of such disability, and do not include family members of the mentioned individuals;

2) Medical workers (specialists and professionals) of state or communal healthcare institutions*;

3) Pedagogical workers of state or communal educational institutions**;

4) Scientific (scientific-pedagogical) workers of educational institutions and research institutions of state or communal ownership***;

*to positions specified in item 2 of this item - according to the Order of the Ministry of Health of March 29, 2002, No. 117 “Directory of qualification characteristics of workers' professions. Issue 78. Health Protection”;
**, ***to positions specified in items 3 and 4 of this item - according to the resolution of the Cabinet of Ministers of June 14, 2000, No. 963 “On approval of the list of positions of pedagogical and scientific-pedagogical workers” (Official Gazette of Ukraine, 2000, No. 24, article 1015);
***to positions of scientific workers - in accordance with Article 31 of the Law of Ukraine "On scientific and scientific-technical activity".
Affiliation to positions is determined by the main job.

Categories of citizens who are eligible for a loan at the base interest rate (7% per annum for 10 years from the date of conclusion of the loan agreement, 10% per annum starting from the first day of the 11th year of the loan agreement):

5) War veterans and their families; participants in hostilities, persons with disabilities as a result of the war, families of deceased war veterans designated by Article 10 of the Law of Ukraine "On the status of war veterans, guarantees of their social protection", as well as families of deceased Defenders of Ukraine.

6) Internally displaced persons;

7) Other citizens of Ukraine who do not own residential real estate or own less than 52.5 square meters - for a single-person family and an additional 21 square meters for each subsequent family member (excluding residential real estate objects located on territories and destroyed real estate objects or damaged real estate objects, the owner (co-owner) of which is the borrower and/or his family).

3. The Borrower and full-age members of his family (his family). 3 of the Borrower and his family (family) members do not belong to persons to whom special economic and other restrictive measures are applied in accordance with the Law of Ukraine "On Sanctions", or persons who have significant economic and political weight in public life (oligarchs) in accordance with the Law of Ukraine "On preventing threats to national security associated with excessive influence of persons who have significant economic and political weight in public life (oligarchs)".

The Borrower ensures the accuracy of the information provided to the lender.

Under family members (relatives) of the Borrower - wife (husband), including individuals living together, connected by common life, but not in a registered marriage (excluding individuals whose mutual rights and obligations do not have a family nature), their minor and underage children (up to 18 years (legal age), if under the law they do not acquire the rights of a legal adult earlier), who live together with the Borrower.

4. The following cannot be the subject of a mortgage:

For candidates who fall under the categories specified in subparagraphs 1-5 of paragraph 2:

  • An apartment in a building that was commissioned:
    • More than 20 years prior to the date of the mortgage agreement, if such real estate is located in Chernihiv, Sumy, Kharkiv, Zaporizhzhia, or Kherson regions;
    • More than three years prior to the date of the mortgage agreement, if such real estate is located in other regions (except Chernihiv, Sumy, Kharkiv, Zaporizhzhia, Kherson regions) or the city of Kyiv;

For candidates who fall under the category specified in subparagraph 6 of paragraph 2:

  • An apartment in a building that was commissioned more than 20 years prior to the date of the mortgage agreement;

For candidates who fall under the category specified in subparagraph 7 of paragraph 2:

  • An apartment in a building that was commissioned more than three years prior to the date of the mortgage agreement;

Housing intended for temporary residence;

A residential house located on a plot that is not designated for residential and public construction;

A summer or garden house;

A building or apartment in a building that is an architectural monument and is listed in the State Register of Immovable Monuments of Ukraine;

Mortgaged items that have existing encumbrances or are under arrest.

according to the Law of Ukraine "On Mortgage", the mortgagor is obliged, at their own expense, to take all necessary measures to properly preserve the mortgaged real estate, unless otherwise provided by law or the mortgage agreement, and immediately, upon the bank's request, provide physical access to the mortgaged property.

Warning:
the client must repay the loan amount, commissions, and interest for its use according to the terms of the agreement and the requirements of Ukrainian legislation, including:
- repayment of the loan amount, commissions, and payment of interest for its use within the terms and according to the payment schedule provided in the consumer loan agreement (if the loan is in the form of a credit account or credit line, the payment schedule may not be provided).
- early repayment of the consumer loan in full at any time and without additional charges related to early repayment, or an increase in the amount of periodic payments for its repayment.

Warning:
the mortgage on the property ceases in the event of full repayment of the client's debt under the agreement, the expiration of the mortgage agreement, or the realization of the mortgaged property according to the Law of Ukraine "On Mortgage" (applies to consumer loans secured by mortgage and consumer loans for the purchase of housing).

Warning:
the bank has no right to unilaterally amend agreements concluded with clients unless otherwise provided by the agreement or law.

Warning:
early repayment of the consumer loan in full at any time and without additional charges related to early repayment, or an increase in the amount of periodic payments for its repayment.

Warning:
the bank is prohibited from requiring the client to purchase any goods or services from the bank or an affiliated or related person as a mandatory condition for providing these services (except for providing a package of banking services).

Warning:
the client has the opportunity to refuse to receive advertising materials through remote communication channels.
