According to the Law of Ukraine No. 1349-IX dated 19.03.2021 "On Amendments to certain laws of Ukraine concerning consumer protection in the settlement of overdue debts," JSC "Globus Bank" adheres to the following requirements for ethical behavior when dealing with problematic borrowers:Employees of JSC "Globus Bank" and collection companies acting in the interest of JSC "Globus Bank" in the settlement of overdue debt must interact with the consumer, their close persons, representative, heir, guarantor, property guarantor, or third parties in the settlement of overdue debt exclusively through:1) Direct interaction (telephone and video negotiations, personal meetings). Personal meetings are possible only from 9 a.m. to 7 p.m., provided that the person with whom the interaction is conducted does not object to the meeting and has previously agreed to the personal meeting during a telephone conversation or has given separate written consent to it. The place and time of the meeting must be agreed upon in advance.
2) Sending text, voice, and other messages through telecommunication means, including without the involvement of an employee of the legal entity, which on the date of entry into force of this Law conducts activities related to the settlement of overdue debt, using software or technologies.
3)Sending postal items marked "Deliver Personally" to the place of residence or stay or to the place of work of the individual.
Employees of JSC "Globus Bank" and collection companies acting in the interest of JSC "Globus Bank" in the settlement of overdue debt are prohibited from:
1) Taking actions that infringe on the personal dignity, rights, freedoms, property of the consumer, their close persons, representative, heir, guarantor, property guarantor, and/or other persons, endanger the life, health, or business reputation of these persons, as well as using threats, blackmail, or committing other illegal (unlawful) actions towards these persons;
2) Misleading the consumer, their close persons, representative, heir, guarantor, property guarantor, or third persons about:
- the amount, nature, and grounds for the overdue debt, as well as the consequences that will ensue for the consumer, their close persons, representative, heir, guarantor, property guarantor, or third persons in case of non-fulfillment of the consumer credit agreement;
- referring the matter of overdue debt repayment to court, the possibility of administrative and criminal prosecution measures being applied to the debtor;
- the affiliation of JSC "Globus Bank" and legal entities that, on the date of entry into force of this Law, conduct activities related to the settlement of overdue debt, physical and legal persons engaged on a contractual basis by such entities for direct interaction with the consumer, their close persons, representative, heir, guarantor, or property guarantor, third parties in the settlement of overdue debt, with state authorities and local governments;
3) Interacting with the consumer, their close persons, representative, heir, guarantor, property guarantor, or third persons, and/or their close persons on their own initiative from 8 p.m. to 9 a.m., as well as on weekends, holidays, and non-working days;
4) Interacting with the consumer, their close persons, representative, heir, guarantor, property guarantor, or third persons, and/or their close persons more than twice a day, except in cases of additional interaction at their own initiative. Interaction through means of communication is considered to have taken place if, as a result of such interaction, substantive information about the amount of overdue debt (loan amount, interest on the loan, commission and other payments related to obtaining, servicing, and repaying the loan), the procedure for its repayment, the amount of penalty and other payments charged in case of non-fulfillment of obligations under the consumer credit agreement or according to the law, is conveyed to the person;
5) Concealing information about the contact phone number from which the call is made or the message is sent to the consumer, their close persons, representative, heir, guarantor, property guarantor, third persons, about the postal address or email address from which the message is sent, about the sender of the postal or electronic message;
6) Using the function (service) of automatic redialing to the consumer, their close persons, representative, heir, guarantor, property guarantor, third persons for more than 30 minutes a day;
7) Using images on envelopes or messages sent to the consumer, their close persons, representative, heir, guarantor, property guarantor, or third persons that may be perceived as containing a threat, as well as placing on envelopes or messages information that directly or indirectly indicates the presence of debt, using the inscriptions "executive document", "collection decision", "eviction notice", etc., as well as the names of state authorities, including persons exercising powers in the field of enforcement of decisions;
8) Informing third parties in any way about the consumer's debt or interacting with these persons in such a way that they become aware or may become aware of the consumer's debt, except in cases of interaction with a person to whom the consumer has given consent to transfer information about the presence of overdue debt, as well as other cases provided by law;
9) Demanding from the consumer, their close persons, representative, heir, guarantor, property guarantor, as well as their employer and/or other persons to assume obligations regarding overdue debt if this is not provided for by the consumer credit agreement or the law;
10) Taking actions that damage the reputation, including the business reputation of the consumer, their close persons, representative, heir, guarantor, or threatening to take such actions;
11) Demanding debt repayment in any other way than provided for by the consumer credit agreement or the law;
12) Interacting with the consumer or their close persons on their own initiative in any way if the consumer has informed in writing, providing all duly executed supporting documents, that their interests in the settlement of overdue debt are represented by their representative;
13) Conducting personal meetings with the consumer, their close persons, representative, heir, guarantor, property guarantor, third persons, interaction with whom is provided by the consumer credit agreement and who have given consent to such interaction, without prior agreement of such meetings with the relevant person;
14) Interacting in any way regarding the consumer credit agreement with persons (other than the consumer, their representative, heir, guarantor, property guarantor) who have not given consent to such interaction.
